In his petition, Shariful claimed that the First Information Report (FIR) filed against him was fabricated and that he had been falsely implicated.
The next hearing is now scheduled for April 4. The court has also directed the police to submit their reply regarding the bail application.
Shariful said that he has fully cooperated with the ongoing investigation and that all necessary evidence is already in the possession of the police, making any tampering with it impossible.
The case, which is currently being heard in the Bandra Magistrate Court, is expected to be transferred to the Sessions Court once the police file the chargesheet. As of now, the charge sheet has not been submitted by the Bandra Police.
The attack on Saif Ali Khan occurred on January 16. The actor sustained multiple stab wounds when he confronted the intruder and attempted to restrain him during the alleged robbery attempt. He was rushed to Lilavati Hospital in Bandra, where he underwent emergency surgery. Two days after the attack, Shariful was arrested by Mumbai Police from Thane.
Initially, Shariful was booked under various sections of the Bharatiya Nyaya Sanhita (BNS) related to robbery, dacoity, and trespassing. However, following an investigation, the police added Section 109 (attempt to murder) of the BNS.
The bail plea argued that the charges do not meet the legal criteria for an attempt to murder. “Even if the statements of the witnesses are taken at face value, they do not satisfy the ingredients of Section 311 of BNS, which pertains to robbery with intent to cause death," the plea stated.
